Terms of Service & Fair Usage Policy
1. Acceptance of Terms
By accessing, installing, or utilizing the Vector Reviews platform (“Service”), you agree to be legally bound by these Terms, the Fair Usage Policy, and the Risk Declaration. These terms govern your relationship with Avejan Research and Marketing Tech. If you do not agree to these terms in their entirety, you must immediately cease all use of the Service.
2. Nature and Purpose of the Service
The Service is strictly intended to:
- Provide a structured interface for collecting authentic customer sentiment.
- Identify dissatisfied customers privately to allow businesses to resolve issues internally.
- Offer satisfied customers a streamlined pathway to share their experiences publicly if they choose to do so voluntarily.
The Service is strictly prohibited for use in:
- Generating fraudulent, fake, or "bot" reviews.
- Systematically suppressing negative feedback in a manner that violates third-party (e.g., Google, Yelp) Terms of Service.
- Circumventing the natural ratio of customer feedback through artificial inflation.
3. Comprehensive Fair Usage Policy
3.1 Permitted Professional Use
Users are encouraged to:
- Engage with real customers who have had a genuine transaction with the business.
- Use the platform to improve internal service standards based on private feedback.
- Respect a customer’s decision if they choose not to leave a public review.
3.2 Prohibited Manipulation & Deception
The following actions will result in immediate account termination without refund:
- Review Gating: Explicitly blocking customers with negative experiences from accessing public review links while only allowing positive ones.
- Incentivization: Offering discounts, gifts, or money in exchange for 5-star ratings (this is a violation of FTC and global consumer protection laws).
- Coercion: Pressuring customers or making review submission a mandatory condition of service.
3.3 Automated & Bulk Activity
- The use of scripts, bots, or automated scrapers to interact with the Service is forbidden.
- Users must avoid "unnatural spikes" in review requests that do not match their actual daily footfall or transaction volume.
4. System Behavior & Adaptive UI
Vector Reviews utilizes adaptive UI flows and behavioral variation to optimize user engagement. While these features are designed to enhance the feedback experience, Vector Reviews makes no warranty that these flows will be viewed as compliant by third-party platforms, as their internal algorithms are proprietary and subject to change without notice.
5. Detailed Risk Declaration (Vital)
5.1 Third-Party Platform Enforcement
Google, Meta, Trustpilot, and other platforms use advanced AI to detect "unnatural" review patterns. You acknowledge that use of any third-party feedback tool carries an inherent risk. These platforms may:
- Filter or remove legitimate reviews without explanation.
- Apply a "Warning Label" to your business profile.
- Suspend or permanently ban your Business Profile.
5.2 Algorithmic Misinterpretation
Even with ethical usage, platform algorithms may misinterpret a sudden increase in reviews as "spam." Vector Reviews is not responsible for the actions or errors of these external automated systems.
5.3 Usage-Based Risks
Sending too many review requests in a short window or having a 100% "positive-to-request" ratio is considered a high-risk pattern. You are responsible for maintaining a natural and balanced cadence of requests.
5.4 Customer Whistleblowing
If a customer feels that the feedback flow is deceptive, they may report the business directly to the review platform. You assume all liability for how your customers perceive and report your feedback process.
6. Limitation of Liability & Indemnity
In no event shall Vector Reviews be liable for:
- Total or partial loss of business rankings or visibility.
- Suspension or deletion of Google Business Profiles or other social accounts.
- Direct or indirect loss of revenue resulting from platform penalties.
- Reputational damage arising from customer complaints regarding the feedback process.
7. Compliance with Data Laws
You are the "Data Controller" of the customer information you input into Vector Reviews. You are solely responsible for ensuring you have the legal right (consent) to contact these customers under GDPR, DPDP (India), or other applicable data protection laws.
8. Final Provisions
Vector Reviews is a facilitator of communication, not a guarantor of reputation. Your public reputation remains the result of your actual service quality and the organic choices of your customers.
Continued use of the platform after any modification to these terms constitutes your absolute acceptance of the revised Terms and Risk Declarations.
